Common use of Termination of Right of First Offer Clause in Contracts

Termination of Right of First Offer. The rights of Tenant hereunder with respect to an RFO Premises shall terminate on the earlier to occur of: (i) Tenant’s failure to exercise its Right of First Offer within the ten (10) business day period provided in Section 29.17(b) above; and (iii) the date Landlord otherwise would have provided Xxxxxxxx’s RFO Notice to Tenant, if one or more of the requirements set forth in the first paragraph of this Section 29.17 is not met on the date Landlord otherwise would have provided Xxxxxxxx’s RFO Notice to Tenant.

Termination of Right of First Offer. The rights of Tenant hereunder with respect to an RFO Premises shall terminate on the earlier to occur of: (i) Tenant’s failure to exercise its Right of First Offer within the ten (10) business day period provided in Section 29.17(b30.17(b) above; and (iii) the date Landlord otherwise would have provided XxxxxxxxLandlord’s RFO Notice to Tenant, if one or more of the requirements set forth in the first paragraph of this Section 29.17 30.17 is not met on the date Landlord otherwise would have provided XxxxxxxxLxxxxxxx’s RFO Notice to Tenant.

The rights of Tenant hereunder with respect to an RFO Premises shall terminate on the earlier to occur of: (i) Tenant’s failure to exercise its Right of First Offer within the ten five (105) business day period provided in Section 29.17(b) above; and (iii) the date Landlord otherwise would have provided Xxxxxxxx’s RFO Notice to Tenant, if one or more of the requirements set forth in the first paragraph of this Section 29.17 is not met on the date Landlord otherwise would have provided XxxxxxxxLandlord’s RFO Notice to Tenant.
