Termination of Rights to MAYO Technology. BDSI may, at its option, terminate exclusivity to BDSI Technology if ACCENTIA’s exclusive rights to MAYO technology terminate and ACCENTIA fails to regain exclusive rights to MAYO technology under the ACCENTIA/MAYO Agreement within sixty (60) days. ACCENTIA is responsible for immediately notifying BDSI of any such above noted circumstances.
