Termination of this Licence Agreement. 4.1 Unless the Student has made arrangements with the College Office for late arrival, this Licence Agreement will automatically terminate if the Student has not taken up residence within 7 days of the Licence Agreement. 4.2 The College may terminate this Licence Agreement at any time by serving notice on the Student if: (a) Any payment is overdue by 21 days or more, or (b) The Student is in serious or persistent breach of any of the Student’s obligations as set out in the Green/Red Books, or (c) The Student does not have status as a member of the College or of the University of Oxford (d) In the reasonable opinion of the College the health or behaviour of the Student constitutes a serious risk to themselves or others or the College’s or other people’s property 4.3 The Student may only terminate this Licence Agreement in accordance with this clause, and will remain liable for the rent until: (a) the Student has given 8 weeks’ notice to the Accommodation Manager that they wishe to leave; and (b) the Student makes payment for, or puts right to the College’s reasonable satisfaction any breach of the Student’s obligations in this Licence Agreement; or (c) a replacement Student or College member who is reasonably satisfactory to the College as a tenant and who is not already a tenant of the College enters into a Licence Agreement with the College (the College will assist the Student in finding a replacement, but does not guarantee it will be able to find one); and Conditions (b) to (d) in this clause shall not apply if the Student is able to show that the reason for termination is a serious or persistent breach of the College’s obligations in this Licence Agreement. For the avoidance of doubt, the College will make vacated rooms available to other Students for room transfers, but room swaps will not be treated as replacements and refunds of rent will only be given where the void in the College caused by the Student’s early departure has been filled and there is no loss to the College. The College shall be entitled to fill any rooms which are already vacant before allocating people on its waiting list to the Accommodation. 4.4 If this Licence Agreement is terminated early by either the College or the Student, the College will refund a fair proportion of pre-paid rent (after making any proper deductions to cover its losses) as soon as possible after the termination becomes effective but pre-paid rent will only be refunded for the period where the void in the residence caused by the Student’s early departure has been filled and there is no loss to the College. If the College terminates under Clause 4.2, prepaid rent will only be refunded for the period for which the College is able to, and after it has re-let the Accommodation. 4.5 The College reserves the right to relocate the Student to comparable alternative accommodation during the period of residence where it is reasonable to do so but unless the reason for relocation is because the Student is in breach of one or more of their obligations in this Licence Agreement the Student will have the right to terminate this Licence Agreement (without having to comply with the conditions in clause 4.3) as an alternative to relocating.

(b) the Student makes payment for, or puts right right, to the College’s reasonable satisfaction any breach of the Student’s obligations in this Licence Agreementlicence agreement; orand
(c) a replacement Student or College member who is reasonably satisfactory to the College as a tenant and who is not already a tenant of the College enters into a Licence Agreement licence agreement with the College (the College will assist the Student in finding a replacement, but does not guarantee it will be able to find one); and
(d) the Student pays a fee (of £50 where the College or Student finds a replacement student) towards the College’s costs of administration and cleaning the Accommodation. Conditions (b) to (d) in this clause shall not apply if the Student is able to show that the reason for termination is a serious or persistent breach of the College’s obligations in this Licence Agreementlicence agreement. For the avoidance of doubt, the College will make vacated rooms available to other Students students for room transfers, but room swaps will not be treated as replacements and refunds of rent Rent will only be given where the void in the College caused by the Student’s early departure has been filled and there is no loss to the College. 4.6 The College’s acceptance of the keys at any time shall not in itself be effective to terminate this licence agreement while any part of the Period of Residence remains unexpired.

Termination of this Licence Agreement. 4.1 Unless 5.1 This Licence Agreement may be terminated by any of the ways set out in this Clause 5.
5.2 This Licence Agreement will terminate on the end date and time as specified in the Licensing Details, unless agreed otherwise in writing between The Resident and The Licensor.
5.3 This Licence Agreement will terminate if The Resident is no longer enrolled with The Courtauld Institute of Art as a full-time student and in those circumstances The Licensor will require The Resident to vacate The Room within five working days following receipt of notification of The Resident’s status from Student has made arrangements and Academic Services.
5.4 If and whenever the Accommodation Fee or any part of the Accommodation Fee is not paid within 14 days of becoming due (whether formally demanded or not) or if and whenever there is any breach of or non-performance of The Resident’s other obligations which is a repeated breach or not a minor breach, The Licensor shall be entitled to give The Resident notice requiring The Resident to pay the arrears of any Fees and/or to put right the breach and specifying a reasonable time to do so. If The Resident fails to pay the arrears and/or put the breach right within that time, The Licensor may in its absolute discretion give The Resident not less than 28 calendar days’ notice to terminate this Licence Agreement.
5.5 If there is any breach or non-performance of any of The Resident’s obligations under this Licence Agreement which is of a seriousness or nature that makes it reasonable for The Licensor in its absolute discretion to terminate this Licence Agreement by giving shorter notice than provided for in Clause 5.4 or by giving no notice, then this Licence Agreement shall be terminated at the expiry of such notice or, immediately, if no notice is given, or by The Licensor issuing court proceedings for possession.
5.6 If as a result of a disciplinary hearing pursuant to the disciplinary procedure of The Courtauld Institute of Art, The Resident is excluded from The Courtauld Institute of Art, with the College Office for late arrivalimmediate effect, this Licence Agreement shall terminate and The Resident will automatically terminate if vacate The Room on being given reasonable notice in writing. The Courtauld Institute of Art’s disciplinary procedure can be found at the Student has not taken up residence within 7 days of the Licence Agreementwebsite referred to in Clause 1.2.
4.2 5.7 If The College may Resident after the commencement of this Licence Agreement wishes to vacate The Room prior to 31 December 2023 and terminate this Licence Agreement at any time by serving notice on the Student if:and
(a) Any payment The Resident consults The Licensor’s Student and Academic Services waiting list for a replacement resident who is overdue by 21 days or morewilling to take over the Licence Agreement for the remaining period or, orif The Resident has found another student who meets the allocation policy (which can be obtained from The Licensor’s Student and Academic Services) and
(b) The Student is replacement resident has completed and signed a Licence Agreement and paid a deposit and the relevant accommodation fee instalment in serious or persistent breach of any of the Student’s obligations as set out in the Green/Red Books, orfull and
(c) The Student does not have status Resident (to depart) pays the Administration Charge Then The Resident as named on this Licence Agreement will be released from their obligations under this Licence Agreement but without prejudice to liability for any prior breaches on the part of The Resident.
5.8 If prior to the Commencement Date of this Licence Agreement but after a member signed Licence Agreement has been received together with the Tenancy Deposit, The Resident can cancel this Licence Agreement and get a full refund of the College or Tenancy Deposit paid by contacting the Licensor’s Student and Academic Services team and in such circumstances The Licensor will not be required to provide you with accommodation.
5.9 If The Resident cancels this Licence Agreement less than 14 calendar days prior to the Commencement Date, you will forfeit the Tenancy Deposit and one week’s Accommodation Fee as per the rate stated in the Licensing Details.
5.10 If no notice to cancel is given by the Commencement Date, the Licence Agreement will be binding on you and you will be responsible for the Accommodation Fee for the whole of the University of OxfordLicence Period, even if you do not move into The Accommodation.
(d) In 5.11 The exception to Clauses 5.9 and 5.10 will be if for reasons related to COVID, i.e. The Resident is restricted from traveling within and or to the reasonable opinion of United Kingdom due to national and or international travel restrictions imposed by the College the health or behaviour of the Student constitutes a serious risk to themselves or others UK Government or the CollegeResidents home country’s or other people’s propertyGovernment (if traveling from abroad) and thus, The Resident is unable to move into The Accommodation, The Licensor will agree to mutually terminate the Licence Agreement and no charges as outlined in Clauses 5.9 and 5.10 will be levied.
4.3 5.12 After the Commencement Date stated in this Licence Agreement, The Student Resident may only terminate this the Licence Agreement in accordance with this clause, and will remain liable for Clause 5.7 only.
5.13 After the rent until:
(a) the Student has given 8 weeks’ notice to the Accommodation Manager that they wishe to leave; and
(b) the Student makes payment for, or puts right to the College’s reasonable satisfaction any breach of the Student’s obligations Commencement Date stated in this Licence Agreement; or
(c) a replacement Student or College member who is reasonably satisfactory to , The Licensor may terminate the College as a tenant and who is not already a tenant of the College enters into a Licence Agreement with the College (the College will assist the Student if The Licensor closes or is required to close The Accommodation and is unable to source other suitable accommodation due to circumstances in finding any way connected to but not limited to COVID or a replacement, but does not guarantee it will be able to find one); and Conditions (b) to (d) in this clause shall not apply if the Student is able to show that the similar declared pandemic or for any operational reason for termination is a serious or persistent breach of the College’s obligations in this Licence Agreementbeyond its direct control. For the avoidance of doubt, the College will make vacated rooms available to other Students for room transfers, but room swaps will not be treated as replacements and refunds of rent will only be given where the void in the College caused by the Student’s early departure has been filled and there is no loss to the College. If The College shall be entitled to fill any rooms which are already vacant before allocating people on its waiting list to the Accommodation.
4.4 If Licensor terminates this Licence Agreement it will give The Resident, no less than 4 weeks written notice.
5.14 If The Licensor is terminated early by either the College required to close The Accommodation it will support The Resident in finding suitable alternative accommodation in a similar property owned or the Student, the College will refund a fair proportion of pre-paid rent (after making any proper deductions to cover its losses) as soon as possible after the termination becomes effective but pre-paid rent will only be refunded for the period where the void in the residence caused managed by the Student’s early departure has been filled and there is no loss to the College. If the College terminates under Clause 4.2, prepaid rent will only be refunded for the period for which the College is able to, and after it has re-let the AccommodationUniversity of London or third party accommodation provider.
4.5 5.15 In the unlikely event that The College reserves the right to relocate the Student to comparable alternative accommodation during the period of residence where it is reasonable to do so but unless the reason for relocation is because the Student is in breach of one or more of their obligations in this Licence Agreement the Student will have the right Licensor has to terminate this Licence Agreement (without having under Clause 5.13, it will
1) support The Resident in sourcing suitable alternative accommodation in a similar property owned or managed by the University of London or third party accommodation provider;
2) refund a proportion of the Accommodation Fee paid equivalent to comply the proportion of the period of occupancy which is remaining and, The Resident agrees that in these circumstances you will not be entitled to claim any additional costs for alternative accommodation or moving costs from The Licensor.
5.16 At the end of the Licence Period or where The Licensor terminates this Licence Agreement, The Resident must vacate The Room by midday on the day of termination and remove all personal belongings from it and from communal rooms and return all keys to The Room and The Accommodation to The Licensor.
5.17 Should the Resident not vacate The Room and an extension to the Licence Agreement has not been been agreed in writing with the conditions Licensor at least thirty working days prior to the Expiry Date of the Licence Agrement, The Resident will be liable for additional charges of £120 for each twenty-four hour period The Resident remains within The Room.
5.18 If The Resident does not vacate The Room in clause 4.3accordance with this Clause 5, The Licensor may apply to the court for an order for possession and may claim from The Resident such costs of those proceedings as the court will allow.
5.19 If The Resident during the period of Xxxxxx returns to their registered home address be that in the UK or abroad and is subsequently unable to return to The Accommodation due to local lockdown and or travel restrictions imposed by the UK Government or the Residents home country’s Government (if traveling from abroad) as an alternative due to relocatingCOVID or similar UK Government declared pandemic, the Licensor provide a rebate to the value of 50% of the Accommodation Fee per week for each week the Resident is not able to return and live in The Accommodation capped at a maximum of 4 weeks.
5.20 The termination of this Licence Agreement will not cancel any outstanding liability The Resident has to The Licensor at the date of termination.

Termination of this Licence Agreement. 4.1 Unless the Student has made arrangements with the College Office for late arrival, arrival this Licence Agreement licence agreement will automatically terminate if the Student has not taken up residence within 7 days by the end of the Licence Agreementfirst week of the tenancy, but the Student will be liable for the Rent until the room is re-let or until the end of the licence period, whichever is earlier.
4.2 The College may terminate this Licence Agreement licence agreement at any time by serving notice on the Student if:

(c) The Student does not have status as a member of the College or of the University of Oxford

4.3 The Student may only terminate this Licence Agreement licence agreement in accordance with this clause, and will remain liable for the rent Rent until:
(a) the Student has given 8 weeks’ notice to the Accommodation Manager College’s Domestic Bursar that they wishe s/he wishes to leave; and
(b) the Student makes payment for, or puts right right, to the College’s reasonable satisfaction any breach of the Student’s obligations in this Licence Agreementlicence agreement; orand
(c) a replacement Student student or College member who is reasonably satisfactory to the College as a tenant and who is not already a tenant of the College enters into a Licence Agreement licence agreement with the College (the College will assist the Student in finding a replacement, but does not guarantee it will be able to find one); and
(d) the Student pays a fee (of £25 where the College finds a replacement student or of £25 where the Student finds a replacement student) towards the College’s costs of administration and cleaning the Accommodation Conditions (b) to (d) in this clause shall not apply if the Student is able to show that the reason for termination is a serious or persistent breach of the College’s obligations in this Licence Agreementlicence agreement. For the avoidance of doubt, the College will make vacated rooms available to other Students students for room transfers, but room swaps will not be treated as replacements and refunds of rent Rent will only be given where the void in the College caused by the Student’s early departure has been filled and there is no loss to the College. The College shall be entitled to fill any rooms which are already vacant before allocating people on its waiting list to the Accommodation.
4.4 If this Licence Agreement licence agreement is terminated early by either the College or the Student, the College will refund to the Student a fair proportion of pre-paid rent Rent (after making any proper deductions to cover its losses) as soon as possible after the termination becomes effective but pre-paid rent will only be refunded for the period where the void in the residence caused by the Student’s early departure has been filled and there is no loss to the College. If if the College terminates under Clause 4.2, prepaid rent clause 4.2 pre-paid Rent will only be refunded for the period for which the College is able to, and after it has has, re-let the Accommodation.
4.5 (a) The College reserves the right to relocate the Student to comparable alternative accommodation during the period Period of residence Residence where it is reasonable to do so but unless the reason for relocation is because the Student is in breach of one or more of their obligations in this Licence Agreement licence agreement the Student will have the right to terminate this Licence Agreement licence agreement (without having to comply with the conditions in clause 4.3) as an alternative to relocating.
(b) Where the College relocates the Student because the Student is in breach of one or more of their obligations in this licence agreement [or where the relocation is made at the Student’s request] the Student shall pay the College an administration fee of £25
4.6 The College’s acceptance of the keys at any time shall not in itself be effective to terminate this licence agreement while any part of the Period of Residence remains unexpired

Termination of this Licence Agreement. 4.1 Unless 5.1 This Licence Agreement may be terminated by any of the ways set out in this Clause 5.
5.2 This Licence Agreement will terminate on the end date and time as specified in the Licensing Details, unless agreed otherwise in writing between The Resident and The Licensor.
5.3 This Licence Agreement will terminate if The Resident is no longer enrolled with The Courtauld Institute of Art as a full-time student and in those circumstances The Licensor will require The Resident to vacate The Room within five working days following receipt of notification of The Resident’s status from Student has made arrangements and Academic Services.
5.4 If and whenever the Accommodation Fee or any part of the Accommodation Fee is not paid within 14 days of it becoming due (whether formally demanded or not) or if and whenever there is any breach of or non-performance of The Resident’s other obligations which is a repeated breach or not a minor breach, The Licensor shall be entitled to give The Resident notice requiring The Resident to pay the arrears of any Fees and/or to put right the breach and specifying a reasonable time to do so. If The Resident fails to pay the arrears and/or put the breach right within that time, The Licensor may in its absolute discretion give The Resident not less than 28 calendar days’ notice to terminate this Licence Agreement.
5.5 If there is any breach or non-performance of any of The Resident’s obligations under this Licence Agreement which is of a seriousness or nature that makes it reasonable for The Licensor in its absolute discretion to terminate this Licence Agreement by giving shorter notice than provided for in Clause 5.4 or by giving no notice, then this Licence Agreement shall be terminated at the expiry of such notice or, immediately, if no notice is given, or by The Licensor issuing court proceedings for possession.
5.6 If because of a disciplinary hearing pursuant to the disciplinary procedure of The Courtauld Institute of Art, The Resident is excluded from The Courtauld Institute of Art, with the College Office for late arrivalimmediate effect, this Licence Agreement shall terminate, and The Resident will automatically terminate if vacate The Room on being given reasonable notice in writing. The Courtauld Institute of Art’s disciplinary procedure can be found at the Student has not taken up residence within 7 days of the Licence Agreementwebsite referred to in Clause 1.2.
4.2 5.7 If The College may Resident after the commencement of this Licence Agreement wishes to vacate The Room prior to 31 December 2024 and terminate this Licence Agreement at any time by serving notice on the Student if:and
(a) Any payment The Resident identifies a replacement Resident (another Courtauld enrolled student) who is overdue by 21 days or more, willing to take over the Licence Agreement for the remaining period or,) and
(b) The Student is replacement resident has completed and signed a Licence Agreement and paid as a minimum either a Pre-Payment Fee of £450 or the relevant Accommodation Fee instalment in serious or persistent breach of any of the Student’s obligations as set out in the Green/Red Books, orfull and
(c) The Student does not have status Resident (to depart) pays the Administration Charge Then The Resident as named on this Licence Agreement will be released from their obligations under this Licence Agreement but without prejudice to liability for any prior breaches on the part of The Resident.
5.8 If prior to the Commencement Date of this Licence Agreement but after a member signed Licence Agreement has been received together with the Pre-Payment Fee, The Resident can cancel this Licence Agreement and subject to Clause 5.9 get a full refund of the College or Pre- Payment Fee paid by contacting the Licensor’s Accommodation team and in such circumstances The Licensor will not be required to provide you with accommodation.
5.9 If The Resident cancels this Licence Agreement less than 14 calendar days prior to the Commencement Date, you will forfeit the Pre-Payment Fee and one week’s Accommodation Fee as per the rate stated in the Licensing Details.
5.10 If no notice to cancel is given by the Commencement Date, the Licence Agreement will be binding on you and you will be responsible for the Accommodation Fee for the whole of the University of OxfordLicense Period, even if you do not move into The Accommodation.
(d) In 5.11 The exception to Clauses 5.9 and 5.10 will be if for reasons related to COVID, i.e. The Resident is restricted from traveling within and or to the reasonable opinion of United Kingdom due to national and or international travel restrictions imposed by the College the health or behaviour of the Student constitutes a serious risk to themselves or others UK Government or the CollegeResidents home country’s or other people’s propertyGovernment (if traveling from abroad) and thus, The Resident is unable to move into The Accommodation, The Licensor will agree to mutually terminate the Licence Agreement and no charges as outlined in Clauses 5.9 and 5.10 will be levied.
4.3 5.12 After the Commencement Date stated in this Licence Agreement, The Student Resident may only terminate this the Licence Agreement in accordance with this clause, and will remain liable for Clause 5.7 only.
5.13 After the rent until:
(a) the Student has given 8 weeks’ notice to the Accommodation Manager that they wishe to leave; and
(b) the Student makes payment for, or puts right to the College’s reasonable satisfaction any breach of the Student’s obligations Commencement Date stated in this Licence Agreement; or, The Licensor may terminate the Licence Agreement if The Licensor closes or is required to close The Accommodation and is unable to source other suitable accommodation due to circumstances in any way connected to but not limited to a declared pandemic or for any operational reason beyond its direct control. If The Licensor terminates this Licence Agreement it will give The Resident, no less than 4 weeks written notice.
(c5.14 If The Licensor is required to close The Accommodation it will to its best endeavors support The Resident in finding suitable alternative accommodation in a similar property owned or managed by the University of London or third-party accommodation provider.
5.15 In the unlikely event that The Licensor must terminate this Licence Agreement under Clause 5.13, it will:
1) support The Resident in sourcing suitable alternative accommodation in a replacement Student similar property owned or College member who is reasonably satisfactory managed by the University of London or third-party accommodation provider.
2) refund a proportion of the Accommodation Fee paid equivalent to the College as a tenant and who is not already a tenant proportion of the College enters into a Licence Agreement with period of occupancy, which is remaining and, The Resident agrees that in these circumstances you will not be entitled to claim any additional costs for alternative accommodation or moving costs from The Licensor.
5.16 At the College (the College will assist the Student in finding a replacement, but does not guarantee it will be able to find one); and Conditions (b) to (d) in this clause shall not apply if the Student is able to show that the reason for termination is a serious or persistent breach end of the College’s obligations in Licence Period or where The Licensor terminates this Licence Agreement. For , The Resident must vacate The Room by midday on the avoidance day of doubttermination and remove all personal belongings from it and from communal rooms and return all keys to The Room and The Accommodation to The Licensor, this may be either in person or via the College will make vacated rooms available to other Students for room transfers, but room swaps will not be treated as replacements and refunds of rent will only be given where white post box located on the void right hand wall in the College caused by entrance lobby.
5.17 Should the Student’s early departure has been filled Resident not vacate The Room and there is no loss an extension to the College. The College shall be entitled to fill any rooms which are already vacant before allocating people on its waiting list Licence Agreement has not been been agreed in writing with the Licensor at least ninety working days prior to the AccommodationExpiry Date of the Licence Agreement, The Resident will be liable for additional charges of £265 for each twenty-four-hour period The Resident remains within The Room.
4.4 5.18 If The Resident does not vacate The Room in accordance with this Licence Agreement is terminated early by either the College or the StudentClause 5, the College will refund a fair proportion of pre-paid rent (after making any proper deductions to cover its losses) as soon as possible after the termination becomes effective but pre-paid rent will only be refunded for the period where the void in the residence caused by the Student’s early departure has been filled and there is no loss The Licensor may apply to the College. If court for an order for possession and may claim from The Resident such costs of those proceedings as the College terminates under Clause 4.2, prepaid rent court will only be refunded for the period for which the College is able to, and after it has re-let the Accommodationallow.
4.5 5.19 If The College reserves the right to relocate the Student to comparable alternative accommodation Resident during the period of residence where it Tenancy returns to their registered home address be that in the UK or abroad and is reasonable subsequently unable to do so but unless return to The Accommodation due to local lockdown and or travel restrictions imposed by the reason UK Government or the Residents home country’s Government (if traveling from abroad) due to a UK Government declared pandemic, the Licensor will provide a rebate to the value of 50% of the Accommodation Fee per week for relocation each week the Resident is because the Student is not able to return and live in breach The Accommodation capped at a maximum of one or more 4 weeks.
5.20 The termination of their obligations in this Licence Agreement will not cancel any outstanding liability The Resident has to The Licensor at the Student will have the right to terminate this Licence Agreement (without having to comply with the conditions in clause 4.3) as an alternative to relocatingdate of termination.

Termination of this Licence Agreement. 4.1 Unless the Student has made arrangements with the College Office for late arrival15.1 This Licence shall terminate automatically where:
(a) Pursuant to clause 3.2 and 15.2.2, this Licence Agreement will automatically terminate if the Student has not taken up residence within 7 the first seven days of the commencement of the Licence AgreementPeriod, unless the Student has confirmed alternative arrangements with the University for late-arrival. 4.2 15.2 The College University may terminate this Licence Agreement at any time by serving notice set out in clause 16.1 on the Student if:
(a) 15.2.1 Any payment is overdue by 21 days or more, ; or
15.2.2 Notification from the Registry that you are no-longer enrolled as a Student or enrolled on less than 90 credits in a single academic year.
15.2.3 Having regard to its obligations under the Equality Act 2010, the University shall be entitled to terminate this Licence before the end of the Licence Period by serving reasonable notice on the Student if (bin the University’s reasonable opinion) the Student’s health, or behaviour creates a serious risk to themselves, or to others, or to the property of others; or
15.2.4 The Student is in serious or persistent breach of any his or her obligations under this Agreement, or is found guilty of the Student’s obligations as set out in the Green/Red Books, or
(c) The Student does not have status as a member of the College or of the University of Oxford
(d) In the reasonable opinion of the College the health or behaviour of the Student constitutes a serious risk to themselves or others or persistent disciplinary offence under the CollegeUniversity’s or other people’s propertyDisciplinary Regulations.
4.3 The Student may only terminate 15.3 If this Licence Agreement in accordance with this clause, and will is terminated under clause 15.2 the Student may remain liable for the rent untilfull Fees of the Licence Period unless:
(a) the Halls is licenced to another Student has given 8 weeks’ notice for the remainder of the Licence Period in which case a fair and reasonable proportion of the Fee will be returned to the Accommodation Manager that they wishe to leaveStudent; andor
(b) at the discretion of the University it is otherwise agreed in writing that the Student makes payment foris no longer liable for the full Fees; in which cases, or puts right an Early Termination Charge equivalent to the College’s reasonable satisfaction any breach of 28 days at the Student’s obligations in daily Accommodation Fee rate will apply.
15.4 Subject to clause 15, this Licence Agreement may be terminated by the University giving not less than 28 days written notice to the Student.
15.5 In exceptional circumstances including health and safety issues, or persistent or serious breaches of the terms of this Licence Agreement; or, St Mary’s Disciplinary Procedure, or under the University’s Fitness to Reside Policy, which cause disruption or serious risk to self or others, the notice period may be less than 28 days. In such circumstances a Student may be required to vacate the Halls immediately, without notice or may be temporarily suspended from the Halls pending the outcome of a hearing. Serious and/or persistent breaches include but are not limited to the following:
(ci) a replacement Student substance abuse, dealing or College member who is reasonably satisfactory to the College as a tenant and who is not already a tenant of the College enters into a Licence Agreement with the College supply;
(the College will assist the Student in finding a replacement, but does not guarantee it will be able to find one)i) violent or aggressive behaviour; and Conditions (b( i) to (d) in this clause shall not apply if the Student is able to show that the reason for termination is a serious bullying or persistent breach of the College’s obligations in this Licence Agreement. For the avoidance of doubt, the College will make vacated rooms available to other Students for room transfers, but room swaps will not be treated as replacements and refunds of rent will only be given where the void in the College caused by the Student’s early departure has been filled and there is no loss to the College. The College shall be entitled to fill any rooms which are already vacant before allocating people on its waiting list to the Accommodation.
4.4 If this Licence Agreement is terminated early by either the College or the Student, the College will refund a fair proportion of pre-paid rent (after making any proper deductions to cover its losses) as soon as possible after the termination becomes effective but pre-paid rent will only be refunded for the period where the void in the residence caused by the Student’s early departure has been filled and there is no loss to the College.
