Termination on the. Public Procurement Termination Grounds shall not prejudice or affect any right, liability or remedy which has accrued or shall accrue to the Relevant Authority or the Service Provider prior to or after such termination on Public Procurement Termination Grounds, in respect of the period prior to such termination, save as otherwise expressly provided for in clauses 28.7 to 28.11.
Termination on the basis of genuine operational requirements 22.3.1 When the Company decides that the Company no longer wishes the job the employee has been doing to be done by anyone, or on the basis of genuine operational requirements, the Company may terminate the employee based on this decision. 22.3.2 Before an employee is terminated based on section 22.3.1, the Company must consider, and if available, allow the employee the option of: (a) a suitable alternative job of similar position, status, location & wage level; or (b) a transfer to lower paid duties. 22.3.3 Where the Company offers to the employee suitable alternative employment as outlined in section 22.3.2, and the employee rejects the offer of suitable alternative employment, then the employee will not be entitled to severance pay outlined in section 22.3.4. 22.3.4 Where an employee is terminated based on section 22.3.1, and the Company has considered all options in section 22.3.2, the employee is entitled to severance pay outlined below in addition to the period of notice required in section 22.1. The ordinary rate of pay is the total amount an employee would receive if he/she were performing his/her ordinary hours of work but does not include overtime, loadings, penalty rates, shift allowances, special rates, or any other extraneous payment of a like nature.
