Common use of Terms of Reference for Investigations Clause in Contracts

Terms of Reference for Investigations. (a) The terms of reference issued by Aurizon Network for any routine Investigation in accordance with Clause 1.1 of this Schedule will be to determine the cause of the Incident and to stipulate what action has been or will be taken to prevent recurrence. (b) The terms of reference issued by Aurizon Network for any major Investigation in accordance with Clause 1.2 of this Schedule shall, as a minimum, be to : i. ascertain probable causes; ii. assess contributing factors; iii. review current procedures for ensuring system integrity; iv. make draft recommendations; v. estimate direct and associated costs; and vi. consider whether immediate remedial actions are required. (c) Additional terms may be added if agreed by the Parties or if determined in accordance with paragraph 1.3(f) of Part 1 of this Schedule.
