Common use of Terms of Reference of the Arbitration Panel Clause in Contracts

Terms of Reference of the Arbitration Panel. Unless the Parties otherwise agree, within 20 days of the date of receipt of the request for the establishment of the arbitration panel, the terms of reference of the arbitration panel shall be: “To examine, in the light of the relevant provisions of the Korea-Turkey FTA, the matter referred to in the request for the establishment of an arbitration panel pursuant to Article 6.5, to make findings together with the reasons on the compatibility of the measure with the Korea-Turkey FTA, and to issue a written report containing the reasons for the findings for the resolution of the dispute.”
