TERMS OF THE PRELIMINARY APPROVAL ORDER. 38. Concurrently with their application for preliminary Court approval of the Settlement contemplated by this Stipulation, which shall be filed within five (5) business days of the filing of this Stipulation, Lead Counsel and Defendants’ Counsel shall apply to the Court for entry of the Preliminary Approval Order, which shall be substantially in the form attached hereto as Exhibit A. The Preliminary Approval Order will, inter alia, set the date for the Settlement Hearing and prescribe the method for giving notice of the Settlement to the Settlement Class.
