Text Message Carrier Requirements. If Client purchases text message archiving as a SaaS Service, this Section applies. Client is only permitted to archivetextmessagesfor Client’scurrentemployees. Client is not permitted to activelyarchivetextmessagesfor any individualwho is not a Client employee. Client agrees to notify Smarsh immediately when any employee’s employment is terminated. Client agrees to provide each employee with clear and conspicuous policies regarding the receipt, transmission, storage and use of employee text messages. Client is responsible for ensuring that each employee has agreed to such policies and that each employee has been made aware that such employee has no reasonable expectation of privacy in such employee’s text messages. Each telecommunications carrier may have a different implementation process. The implementation process is dependent on actions to be completed by Client and theapplicabletelecommunicationscarrier. Smarsh is notresponsiblefordelays in implementationcausedby telecommunication carriers, Client or Client employees. Client is responsible for following all implementation processes and procedures communicated to Client during the implementation process. In order to archive text messages generated by a Verizon mobile account, each employee will be required to accept a request to archive sent by Verizon directly to the employee device. If the employee device does not accept or respond to such request, Verizon will not release the text message to Smarsh.
