Common use of The Concessioning Authority Event of Default Clause in Contracts

The Concessioning Authority Event of Default. (i) the Concessioning Authority’s failure to perform or discharge its obligations in accordance with the provisions of this Agreement unless such failure has occurred as a consequence of any Concessionaire Event of Default or a Force Majeure Event. (ii) any representation made or warranties given by the Concessioning Authority under this Agreement is found to be false or misleading. (iii) appointment of a provisional liquidator, administrator or receiver of the whole or part of the Port’s Assets in any legal proceedings initiated against the Concessioning Authority (unless such proceedings are initiated as a consequence of any Concessionaire Event of Default). (iv) levy of an execution or destraint on the Port’s Assets in any proceedings against the Concessioning Authority (unless such proceedings are initiated as a consequence of any Concessionaire Event of Default) which has or is likely to have Material Adverse Effect and such execution or destraint remaining in force for a period exceeding 90 (ninety) Days.
