The Contractor Representations and Warranties. In addition to the warranties set forth above, the Contractor represents and warrants that: A. The Contractor possesses full power and authority to enter into this Agreement and to fulfill its obligations hereunder. B. The performance of the terms of this Agreement and of the Contractor’s obligations hereunder shall not breach any separate agreement by which the Contractor is bound; and C. The Contractor is financially sound to perform its obligations hereunder and agrees that any material adverse change in such status shall be immediately communicated in writing to the District.
