Common use of The FO Clause in Contracts

The FO. (a) does not provide any services under this Agreement other than the facilitation of the storage of goods in the Space; (b) does not have, and will not be deemed to have, knowledge of the goods in the Space; (c) is not a bailee nor a warehouseman of the goods stored in the Space and the Xxxxxx acknowledges that the FO does not take possession of the goods stored in the Space; and (d) claims a contractual lien over all goods stored in the Space until the FO receives payment of any sum due to it by the Xxxxxx . Subject to the provisions of this Agreement, if the FO does not receive payment of any sum payable to it in accordance with the provisions o f this Agreement, the Xxxxxx will be deemed to be in default of its obligations under this Agreement and FO may take such Default A ction as it deems appropriate.

The FO.
