Common use of The FO Clause in Contracts

The FO. (a) does not provide any services under this Agreement other than the facilitation of the storage of goods in the Space; (b) does not, and will not be deemed to, have knowledge of the goods in the Space; (c) is a bailee of the goods in the Space at any given time during the Storage Period; and (d) has both a general xxxx and a contractual lien over all goods stored in the Space until the FO receives payment of any sum due to it by the Xxxxxx. Subject to the provisions of this Agreement and the PPSA (as applicable), if the FO does not receive payment of any sum payable to it in accordance with the provisions of this Agreement, the Xxxxxx will be deemed to be in default of its obligations under this Agreement and FO may take such Default Action as it deems appropriate.

The FO.
