Common use of The Global Agent in Individual Capacity Clause in Contracts

The Global Agent in Individual Capacity. The Global Agent and its Affiliates may make loans to, accept deposits from and generally engage in any kind of business with the Parent, the Company, and their Subsidiaries and Affiliates as though not acting as Global Agent hereunder. With respect to the Loans made by it and all Obligations owing to it, the Global Agent shall have the same rights and powers under this Agreement as any Lender and may exercise the same as though it were not the Global Agent, and the terms “Lender” and “Lenders” shall include the Global Agent in its individual capacity.
