THE LESSOR'S RIGHT TO ADVANCE THE PROJECT FUNDS. Without at any time waiving any of the Lessor's rights hereunder, the Lessor shall have the right to make the first advance of a portion of the Project Funds hereunder without the satisfaction of each and every condition precedent to the Lessor's obligation to make such advance, and the Lessee agrees to accept such advance as the Lessor may elect to make. The making of any advance hereunder shall not constitute an approval or acceptance by the Lessor of any work on the Project theretofore completed.

  • Collection Costs and Attorneys’ Fees If a Party fails to perform an obligation or otherwise breaches one or more of the terms of this Agreement, the other Party may recover from the non-performing breaching Party all its costs (including actual attorneys’ and investigative fees) to enforce the terms of this Agreement.
