Common use of The Plan and Other Agreements Clause in Contracts

The Plan and Other Agreements. The text of the Plan is incorporated in this Agreement by reference. Capitalized terms used in this Agreement and not otherwise defined herein shall have the meanings ascribed to them in the Plan. This Agreement (including any attachments and, where applicable, references to the Employment Agreement) and the Plan constitute the entire understanding between you and the Company regarding this grant of PSUs. Any prior agreements, commitments or negotiations concerning this grant of PSUs are superseded. To the extent the terms of this Agreement conflict with the terms of the Plan, the terms of this Agreement shall prevail.
