Common use of The Pledgee May Perform Clause in Contracts

The Pledgee May Perform. If the Pledgor fails to perform any of its obligations under this Agreement regarding the creation, perfection, maintenance or enforcement of the Pledge, the Pledgee may, but shall not be obligated to, perform to the fullest extent permitted by the applicable law, or cause the performance of, such obligations, and the documented expenses of the Pledgee incurred in connection with such performance shall be payable by the Pledgor in accordance with the Facilities Agreement.

The Pledgee May Perform. If the Pledgor fails to perform any of its obligations under this Agreement regarding the creation, perfection, maintenance or enforcement of the Pledgeagreement contained herein, the Pledgee may, as the Pledgee deems necessary to protect the security interest granted hereunder in the Collateral or to protect the value thereof, but shall not be obligated towithout any obligation to do so and without notice, perform to the fullest extent permitted by the applicable lawitself perform, or cause the performance of, such obligationsagreement, and the documented expenses of the Pledgee incurred in connection with such performance therewith shall be payable by the Pledgor in accordance with the Facilities Agreementunder Section 14.
