Common use of Third Party Enforcement Rights Clause in Contracts

Third Party Enforcement Rights. 24.1 Each of the persons to whom clauses 9.1 and/or 9.2 applies may under the Contracts (Rights of Third Parties) Act 1999 enforce the terms of clauses 9.1 and/or 9.2 (as applicable). This right is subject to: (i) the rights of the Parties to rescind or vary this Agreement without the consent of any other person; and (ii) the other terms and conditions of this Agreement. 24.2 Except as set out in clause 24.1, a person who is not a party to this Agreement shall have no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any of its terms.

This right is subject to: (i) : 22.1.1 the rights of the Parties parties to rescind or vary this Agreement without the consent of any other person; and (ii) and 22.1.2 the other terms and conditions of this Agreement. 24.2 22.2 Except as set out in clause 24.122.1, a person who is not a party to this Agreement agreement shall have no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any of its terms.
