Common use of Third Party Guarantees and Warranties Clause in Contracts

Third Party Guarantees and Warranties. If any of the Site Acquisition or Construction Management Services requires the purchase of equipment or materials or the procurement of services, BTS Company shall make reasonable efforts to obtain from all vendors and subcontractors commercially reasonable guarantees and Warranties with respect to such equipment, materials and services. BTS Company's liability with respect to such equipment and materials obtained from vendors or services from subcontractors shall be limited to procuring guarantees from such vendors or subcontractors and rendering all reasonable assistance to Horizon as part of the Site Development Services for the purpose of enforcing the same.
