Common use of Third Party Interests Clause in Contracts

Third Party Interests. The Company hereby represents to the Debenture Trustee that any account to be opened by, or interest to be held by, the Debenture Trustee in connection with this Indenture, for or to the credit of the Company, either: (a) is not intended to be used by or on behalf of any third party; or (b) is intended to be used by or on behalf of a third party, in which case such third party hereto agrees to complete and execute forthwith a declaration in the Debenture Trustee’s prescribed form as to the particulars of such third party.

Third Party Interests. The Company hereby represents to the Debenture Trustee that any account to be opened by, or interest to be held by, by the Debenture Trustee in connection with this Indenture, Indenture for or to the credit of the Company, either: Company either (ai) is not intended to be used by or on behalf of any third party; or or (bii) is intended to be used by or on behalf of a third party, in which case such third party hereto the Company hereby agrees to complete complete, execute and execute deliver forthwith to the Trustee a declaration in the Debenture Trustee’s prescribed form as to the particulars of such third party.
