Third Party Software/ Open Source Software. Customer acknowledges that the Software may contain or be accompanied by certain Third- Party Products including Open Source Software. Any Open Source Software provided to Customer as part of the Offering is copyrighted and is made available to Customer under the GPL/LGPL and other Open Source Software licenses. Copies of, or references to, those licenses may be set out in a Product Order Form, the Third-Party Product packaging or in a text file, installation file or folder accompanying the Software. If delivery of Open Source Software source code is required by the applicable license, Customer may obtain the complete corresponding Open Source Software source code for a period of three years after Darktrace’s last shipment of the Software by sending a request to: Attn: Legal Department - Open Source Software Request, Darktrace Holdings Limited, Xxxxxxx Xxxxxx Building, Xxxxxx Road, Cambridge CB4 0DS, United Kingdom. All other implied licenses are disclaimed, and all rights not expressly granted herein are reserved to Darktrace.

Third Party Software/ Open Source Software. The Software may include Third-Party Software, including software that is governed by open-source licenses. Certain provisions of open-source licenses are required to be in- cluded in distributions of open-source software. Licensee agrees to these open-source license provisions by using the Software. Any open-source soft- xxxx is provided with the rights set forth in the applicable open-source li- censes, and is provided “as is” with no warranties. For the avoidance of doubt, open-source licenses do not apply to Contract Tools, the Floating Li- cense Server, or to the Software as a whole. Paper Software has sufficient rights to Third-Party Software to grant the rights set out in Section 2.1.
Third Party Software/ Open Source Software. (1) Third-Party Software is subject to the license terms of the respective provider. They are provided to the Customer in the Trust Center or as a link to the website of the third- party provider.
(2) Notwithstanding the Customer's aforementioned rights to use the Contract Software, the terms of the open source software licenses applicable to relevant parts of the Con- tract Software or any components provided with it shall remain unaffected. Insofar as the terms of such open source license conflict with these GTC, the terms of the open source software license shall take precedence.

Third Party Software/ Open Source Software. Escalon will notify MMI, prior to delivery, of any third party Software in Updates, and any third party Software used in the development of Updates, that is not otherwise listed in Exhibit B as of the Effective Date, and the parties will execute an amendment to Exhibit B and such additional third party Software will be deemed to be Third Party Software under this Agreement. Escalon will notify MMI, prior to delivery, or any Open Source Software that is embedded in or combined with Updates that is not listed in Exhibit C as of the Effective Date, and the parties will execute an amendment to Exhibit C. In any event, with respect to such additional Open Source Software, Escalon will not use it in a way that violates Section 5.2.6 as it applies to Updates.
Third Party Software/ Open Source Software. Notwithstanding anything herein to the contrary, Licensed Software may include Third Party Software that is adapted for use with any Mercury operating system and tools, and that is distributed and licensed under the GNU General Public License (GPL), Lesser General Public License (LGPL), or other Open Source Software or Third Party licenses, the terms and conditions of which may be applicable to and enforceable against Licensee. In such case the terms and conditions of the applicable Open Source Software or Third Party licenses shall govern the use of such Third Party Software, and not any of the licenses set forth in Section 2.1 above. Prior to using the Licensed Software, it is Licensee’s responsibility to review and agree to such licensing, copyright and warranty terms. Examples of software that falls under this category, includes, but is not limited to, Third Party board support packages (BSPs), Third Party Eclipse plug-ins, IBM machine code and programs, Yellow Dog Linux, GNU GCC, GDB, DDD software, OpenIPMI, PERL, and others that may be added to software from time to time. Third Party Software/ Open Source Software. The Services may incorporate Third Party Software, including Open Source Software, which is provided under a separate license such as the GPL/LGPL. In the event of a conflict between this Agreement and any separate license, the separate license will prevail with respect to the Services that are the subject of such separate license.
Third Party Software/ Open Source Software. The Software may contain components of third- party Software and/or open-source Software, for which separate license terms must be observed. Insofar as this is necessary for the lawful use of the Software, the applicable third- party or open-source Software license terms are listed in the corresponding Software directories. The licensee undertakes not to install or use the Software until they also agree to these third- party Software or open-source Software license terms, which take precedence over these License Terms. If the licensee rejects this, the licensee shall refrain from installing and using the Software.
