Third Party Stipulation. Each of the undertakings in this Agreement given for the benefit of the Discloser is also given for the benefit of, and will be enforceable by, the members of the Group as an irrevocable third party stipulation without consideration (onherroepelijk derdenbeding om niet).
Third Party Stipulation. This Agreement does not contain any third party stipulation (derdenbeding) in favour of any person.

Third Party Stipulation. This letter is enforceable by any Manager and their respective affiliates (as defined in Rule 501 of Regulation D under the Securities Act (the “Affiliates”)) as a third party stipulation (stipulation pour autrui). The Managers and each of their respective Affiliates are entitled to rely and will rely upon the truth and accuracy of the representations, warranties, agreements and acknowledgements contained in this letter, and have the benefit of the provisions of this letter as if they were a party.
Third Party Stipulation. The Manager and BNYM agree that this Clause 11 shall also be for the benefit of the Fund and the Investors, constituting a third party stipulation (derdenbeding) within the meaning of section 6:253 of the Dutch Civil Code (Burgerlijk Wetboek).
Third Party Stipulation. The provisions of this Clause 13 (Other limitations of liability and management of claims) are also for the benefit of, and shall be enforceable by, the Group Companies, each of their successors, permitted assigns and any member of the Management Board or Supervisory Board, as third-party stipulations (onherroepelijk derdenbeding) and apply mutatis mutandis to any claim made by a third party under a third-party stipulation included in this Agreement.
Third Party Stipulation. The undertakings of the parties hereunder shall also be deemed to establish an irrevocable thrid party stipulation (derdenbeding) as referred to in section 6:253 Dutch Civil Code in favor of Concordia Fund B.V. for as long as the latter person is a shareholder in Sylphar Holding B.V. By signing this agreement the parties acknowledge that the terms hereof have been accepted for that purpose by Concordia.
Third Party Stipulation. 13.1 The provisions set forth in clauses 2, 3, 4 and 12.1 of this Agreement for the benefit of the Purchaser shall also be for the express benefit of HI Holdings Playa B.V. by means of an irrevocable third party stipulation (“derdenbeding”) without consideration, as referred to in article 6:253 of the Dutch Civil Code. Third Party Stipulation. In the event any third party stipulation (derdenbeding) is accepted by a third party, such third party shall not become a party to this Agreement.
