Time and Material. Where the time and material price method is selected by Owner, Contractor shall perform such authorized extra Work for the sum of: (i) the actual cost of direct labor (working foremen, journeymen, apprentices, helpers) that undertook the extra work; (ii) the actual cost of labor burden associated with (i); (iii) the actual cost of material used in performing the extra Work; (iv) the computed cost or actual cost of rental of major equipment; (v) actual costs of additional general liability insurance and performance bond (vi) the Markup Percentage Fee applied to items (i), (ii), (iii) and (iv) without any charge for administration and supervision including management, superintendents and general foremen, and the cost of or rental cost of small tools and minor equipment (defined as having a purchase price of less than $1,000). Owner and Contractor may agree in advance in a Change Order on a maximum price for Work priced on such basis, and Owner shall not be liable for amounts in excess of that maximum. (i) Direct Labor
Time and Material. Work performed on a time and material basis includes the contracted amount per Individual Labor Hour, any and all equipment fees, plus any Materials supplied by CTL for use on Client’s property. This may include, but is not limited to, the travel to and from the Work site, time spent preparing prior to the Work, time spent cleaning and organizing after the Work is performed, and debris disposal.
Time and Material. If Owner and Contractor are unable to agree on the basis of pricing a Change Order pursuant to Sections 19.4.1 or 19.4.2 above, then Contractor shall be paid on a time and material basis in accordance with Section 19.4.4, provided that: (1) such costs are reasonably and properly incurred by Contractor; (2) such costs are documented as required in this Section 19.4.3; (3) such costs would not have been incurred but for the change in the Work; and, for those Requests for Change Orders under Section 19.3, (4) Contractor is entitled to relief for such Request for Change Order in accordance with the terms of this Contract. To be considered eligible for reimbursement, Contractor shall strictly comply with the following requirements: (a) Contractor shall collect and preserve concurrent time and materials data and records for all Work performed on a time and material basis. Contractor shall, on a daily basis, notify Owner of the scope of Work that is being performed on a time and material basis and, no later than 10:00 a.m. the following day present a summary of the time and material expended by Contractor for performing such activities. Owner will note any observations regarding the Work and countersign the time and material record sheet. Contractor shall, at the end of each week, or at such other intervals as Owner may direct, furnish to Owner the following information: (i) Countersigned daily time records for manual and non-manual labor showing the name of each employee performing the Work, the number of hours (with straight time and overtime hours identified separately) employed thereon, the individual’s duties, and the wage rate paid to the employee; (ii) The rates and amounts of workers’ compensation insurance premiums, and state and federal taxes based on such wages; (iii) Vacation allowances, union dues and assessments and health, welfare, employment and retirement benefits which the employer actually pays based on such wages; (iv) The amount and character of the Equipment and Materials furnished and/or installed in performing the Work, including the quantities installed on a daily basis; (v) Construction equipment and other apparatus owned or rented in performing the Work, from whom they were purchased or rented, the description of the Work performed by each equipment or apparatus, the operating and standby hours, the transportation costs and the equipment rates or the amount paid therefore; and (vi) Payments made to approved Subcontractors (with copies o...
Time and Material. Should the Owner or Construction Manager elect to have any extra Work performed on a time-and- material basis in lieu of Lump Sum Proposal or Unit Prices, and so notifies the Contractor in writing, the Contractor shall perform such Work at actual cost (without any charge for administration, clerical expense, supervision or superintendence of any nature whatever, including foremen, or the cost, use or rental of tools or plant) plus a maximum of 15% for overhead and profit. To this figure the Contractor may add Unemployment Insurance and Social Security taxes paid on labor required for the extra Work. Moreover, if the Contractor procures the performance of extra Work by others rather than its own employees, the Contractor shall not be entitled to greater payment than that to which it would have been entitled if it had itself furnished the labor and materials required in connection with the Work to be performed under this provision. The Contractor will submit to the Owner and Construction Manager daily time and material tickets. The time and materials tickets shall not be valid and Contractor shall not be entitled to payment for any such tickets unless they are signed by an authorized representative of the Owner or Construction Manager. These tickets will include the identification number assigned to this Work, the location and description of the Work, the classification of labor employed including workers' names and social security numbers, the material used, the equipment rented (not tools) and any other information ordered by the Owner and/or Construction Manager. All markup for overhead and profit under (a) (b) and (c) above shall be inclusive of any and all costs and expenses including, but not limited to, all overhead of whatever kind or nature, and all supervision, management, administration, estimating or other costs.

Time and Material. If for the purpose of authorizing Work to proceed upon issuance on an MCR prior to the Owner receiving proposal of costs, so that labor or material costs are to be accumulated for later inclusion into a proposal to adjust the contract sum, the MCR must clearly state conditions and limitations of time-and-material work to proceed under the change in Work with costs to follow provision of the MCR. At a minimum, the MCR shall state the maximum allowable cost. In addition, the Daily Job Report must reflect all appropriate detail on related Work, such as work performed that day, number of workers, materials received and similar. A separate daily worker log must also be maintained that will be included in the proposed cost of the MCR. The daily worker log for each MCR, must list each worker, the type of work performed and the hours worked, and must be signed-off daily by an individual, agreed upon in the MCR, that may be the Project Superintendent.
