Time and place for the Contractor. s performance‌ Software and equipment shall be delivered by the deadlines set out in Appendix 4. Unless otherwise is stipulated in Appendix 4, any objections on the part of the Customer shall be submitted in writing by no later than five (5) working days after all the software and equipment covered by the Agreement has been physically delivered to the agreed address. In the case of software, it is sufficient that the software has been made available to the Customer for digital downloading, unless such downloading cannot be performed pursuant to the Contractor's specifications, with this not being due to circumstances related to the Customer, and the Customer notifies the Contractor of this within a reasonable period of time. If the Customer has not submitted objections by the deadline, the delivery date shall be deemed to have taken place on the day the last component of the software and equipment was physically delivered. If a specific approval test has been agreed pursuant to clause 2.2.2, delivery shall not be deemed to have taken place until the approval test has been completed and approved by the Customer.
