Time-barred claims enforcement of the rights of any party may become time-barred by limitation, prescription or laches;
Time-barred claims. If any Subordinated Investor is unable to take proceedings against any Obligor because of any restrictions contained herein and is in danger of being time barred from taking such proceedings it shall be able to make such a claim to prevent such time bar, provided that the relevant Subordinated Investor shall only be entitled to pursue any proceedings in connection with such claim to the extent necessary to prevent such time bar or to prevent any such proceedings from being struck out. Any amounts received by a Subordinated Investor in connection with any such claims shall be subject to turnover and application as provided in Clause 10 (Turnover).
