Time for Delivery. ETSU shall not be liable to Resident for any damages resulting from ETSU's inability to deliver possession of the Premises to Resident at the commencement of the Term, provided however, Resident shall not be liable for payment of any rent until possession of the Premises has been delivered to Resident. Resident may cancel this Agreement if possession of the Premises has not been delivered within 30 days of the commencement of the Term.
Time for Delivery. The goods to be provided by the CONTRACTOR to the CITY shall be delivered, as specified in each purchase order as may be issued hereunder.
Time for Delivery. Such Securities will be deemed to have been delivered by the Lender to the Borrower on delivery to the Borrower or as it directs of the relevant instruments of transfer and certificates or other documents of title (if any), or in the case of Securities title to which is registered in a computer based system which provides for the recording and transfer of title to the same by way of electronic entries (such as CHESS), on the transfer of title in accordance with the rules and procedures of such system as in force from time to time, or by such other means as may be agreed.
Time for Delivery. Any time advised for Delivery is an estimate only. OjiFS will use reasonable endeavours to deliver the Goods in accordance with the estimate, but is not liable for any delay.
Time for Delivery. The time for delivery under Section 6.4 shall be the later of three (3) months after Vyrix’s receipt of Endo’s order or three (3) months after Endo’s approval of packaging artwork, except for the first order which is described in Section 6.3.
Time for Delivery. All Products subject to this Contract shall be delivered no later than ________________________, 20__.
Time for Delivery. 4.1 The Seller shall at its sole expense adequately pack and protect the Goods against damage or deterioration of any nature or sort and deliver them carriage paid not earlier or later than the time(s) specified in the Purchase Order at the delivery point(s) specified therein or as QVC shall otherwise direct. Time of delivery shall be of the essence. For the avoidance of doubt, unless stated otherwise on the Purchase Order, the Seller shall be solely responsible for all freight, packing and insurance charges whatsoever in relation to the delivery of the Goods to such delivery point.
4.2 In the event of any actual or anticipated delay in delivery, the Seller will promptly inform QVC in writing by the fastest possible means of the Seller’s earliest possible delivery date. If the Goods or any part thereof are not delivered (or QVC believes are not capable of delivery) as specified in the Purchase Order, QVC may exercise any of the remedies set out in Condition 8.1.
Time for Delivery. Seller shall satisfactorily and timely deliver the Supplies in full to the District as specified in the District’s bid package documents for Bid No. 23-24/004 (“Bid Package”), including but not limited to any addenda. Time is of the essence in this Contract. If Seller fails to satisfactorily and timely deliver the Supplies, the District may purchase supplies from other sources and recover damages from Seller as allowed by applicable law, including but not limited to the purchase cost in excess of the contract price (see next section) and other costs incurred due to Seller’s failure to timely deliver.
Time for Delivery. 1. Delivery times where given will be approximate and date from the confirmation of the order by WPDT. Under no circumstances shall delivery times be or be capable of being made of the essence of the contract.
2. WPS shall use its reasonable endeavours to deliver the Goods by the stated delivery date, but shall not be liable for any loss whatsoever in the event of late delivery or non-delivery of Goods. The Customer shall not be entitled to refuse to accept late delivery or treat late delivery as a breach of contract.
3. WPS may at its option deliver by instalments in which case each instalment shall constitute a separate contract on these terms and conditions. Default in delivery or defect in any one such instalment shall not entitle the Customer to repudiate the contract nor to cancel subsequent instalments.
4. Where Goods are being sold subject to payment terms as set out in Clause 12 (1)
(a) If WPDT does not receive payment of the offer price (or relevant part thereof) within 14 days of notification that the Goods are available for despatch WPDT shall be at liberty to arrange storage either at WPDT’s premises or elsewhere at the Customer’s risk and charge for storage, insurance and demurrage at the rate of 2% of offer price per month from the date of notification that the equipment is available for despatch until actual despatch.
5. If the Customer has failed to collect the goods on the expiry of the seventh day following notification of readiness for collection or has failed to take delivery, the WPDT shall be entitled to treat the contract as repudiated by the Customer. Until the contract is so terminated the WPDT may, at its option, either store the Goods itself or have them stored by third parties on such terms as it in its absolute discretion thinks fit. The cost of storage and any additional transportation will be added to and form part of the price. If WPS elects to treat the contract as repudiated in accordance with this term it shall (without prejudice to its rights and remedies in respect of such repudiation) be entitled to sell the Goods and retain the proceeds of the sale and to claim from the Customer any shortfall between such proceeds of sale and the price which should have been payable by the Customer.
Time for Delivery. The statements referred to in paragraph (i) of Section 4.14.1 hereof shall be delivered to Lender within ninety (90) days after the last day of each fiscal year of Borrower. The statements referred to in paragraphs (ii) and (vi) of Section 4.14.1 hereof shall be delivered to Lender within thirty (30) days after the last day of each calendar quarter. The reports referred to in paragraphs (iii) and (vii) of Section 4.14.1 hereof shall be delivered to Lender within twenty (20) days after the last day of each calendar month. Notwithstanding anything to the contrary, the information required under paragraph (v) of Section 4.14.1 hereof shall be delivered to Lender simultaneously with delivery to the partners/members of Borrower but in no event later than ninety (90) days after the last day of each fiscal year of Borrower. All Financial Statements shall be in form and substance satisfactory to Lender.
