Time of Essence; Notice of Delay. 10.1.1 Time is of the essence of this Agreement. 10.1.2 Developer shall promptly notify TxDOT in writing of any occurrence of a delay event and of the steps that Developer intends to implement to mitigate the delays arising therefrom.
