Additionally, other matters not reflected in the Title Documents may affect the title, ownership and use of the Property, including without limitation boundary lines and encroachments, area, zoning, unrecorded easements and claims of easements, leases and other unrecorded agreements, and various laws and governmental regulations concerning land use, development and environmental matters. Buyer acknowledges that Buyer has had the opportunity to review the condition of the title, seek its own legal or other counsel or title insurance product, examine such government records of title or otherwise related to the Property as it deems appropriate, and hereby accepts all risk as to the condition of title. b. b. The entirety of the 70 acre real property, including those portions upon which the construction building and bow shop building have been erected, is subject to a right of first refusal held by the tenant of the cell tower located on the property. Upon sale of the real property to a third person, including at this auction, the tenant of the cell tower has thirty days from the date of receipt of written notice of the sale of such property to exercise its right to match the purchase and sale price for the property as determined at auction. Should the right of first refusal be matched, then the cell tower tenant, after closing, shall become the owner of the real property. Should the cell tower tenant fail to exercise its first right of refusal after the thirty day notice period, then the right of first refusal shall lapse and the undersigned Buyer shall consider this contract to be in full force and effect.
