Title and Products, Risk of Loss. Title to and all risk of loss or damage concerning the Products shall pass to Buyer immediately upon the delivery of the Products to a common carrier or to any private carrier designated by Buyer or Mountain, at Mountain’s facility for shipment to Buyer’s designated point of delivery. Xxxxx’s rejection of any Products purchased hereunder shall not shift any risk for those Products until they are returned to and received by Mountain, freight prepaid, pursuant to Mountain’s written instructions.
