Title to Equipment and Software. LOSCAM retains full legal and equitable title to the Equipment and Software at all times, notwithstanding that the Equipment is hired to, and in the possession of, the Hirer and the Software is licensed to, and is being accessed by, the Hirer. Subject to clause 10 in respect of Equipment, the Hirer must ensure that: a) none of the Equipment is sold or otherwise disposed of; b) possession of the Equipment is not shared with or provided to any other person other than in accordance with this agreement; c) no sublease, licence or sub-licence affecting the Equipment or Software is granted to any person; d) it maintains and makes available to LOSCAM on demand at no cost to LOSCAM records detailing the names and addresses of any person in possession of Equipment; e) it maintains and makes available to LOSCAM on demand at no cost to LOSCAM copies of all documentation in relation to the Equipment and/or copies of electronic records from use of the Software in relation to the Equipment; and f) no Security Interest, lien or other encumbrance is created over the Equipment.

  • Equipment and Software To use the Mobile Remote Deposit Services, you must obtain and maintain at your expense, compatible equipment and software that we may specify from time to time.

NEITHER THE COMPANY NOR ANY OF ITS AFFILIATES, SUPPLIERS OR AGENTS SHALL HAVE ANY LIABILITY WHATSOEVER FOR ANY SUCH FAILURE OR DAMAGE, INCLUDING LACK OF 911/E911 CAPABILITY OR DIALING ASSOCIATED WITH A SECURITY SYSTEM. YOUR USE OF CUSTOMER EQUIPMENT MAY PREVENT PROVISION OF SERVICE. The foregoing limitation of liability is in addition to and shall not limit any other limitation of liability set forth in this Agreement.
