Title to Pool Properties. Except as indicated on Schedule 6.3 hereto or other adjustments that are not material in amount, the Pool Property Owners own or lease each Pool Property subject to no rights of others, including any mortgages, leases pursuant to which the Pool Property Owners or any of their Affiliates is the lessee, conditional sales agreements, title retention agreements, liens or other monetary encumbrances except Permitted Liens.
Title to Pool Properties. The Borrower or Guarantor owns in fee simple or Ground Leases each Pool Property subject to no rights of others, including any mortgages, leases pursuant to which such Borrower or Guarantor or any of their Affiliates is the lessee, conditional sales agreements, title retention agreements, liens or other monetary encumbrances except the Leases and Permitted Liens described in clauses (i), (iv), (vi), (viii), (xi), (xiv), (xv) , (xvii), or (xviii) of §8.2.
