Common use of Title to Preserved Causes of Action Clause in Contracts

Title to Preserved Causes of Action. The transfer of the Preserved Causes of Action to the Litigation Trust is made by the Estates for the sole benefit of the Litigation Trust Beneficiaries. Upon the transfer of the Preserved Causes of Action and the Litigation Trust Assets to the Litigation Trust, the Litigation Trust shall succeed to all of the Estates’ rights, title and interests in and to the Preserved Causes of Action and no other Person has any interest, legal, beneficial, or otherwise, in the Litigation Trust or the Preserved Causes of Action as of their transfer and assignment to the Litigation Trust.
