Title to Produced Water. Service Provider shall take title to all Produced Water received by Service Provider or its subcontractors at the Produced Water Receipt Points, other than Produced Water that is to be delivered to Producer’s Produced Water tanks at a Well Pad in accordance with Producer’s instructions, title to which shall be retained by Producer. Producer shall ensure that such Produced Water is free of all liens arising by, through, or under Producer, other than liens arising by operation of law.
