Title to Right. of-Way TxDOT shall hold title to all Project right-of-way. Developer and other third parties may obtain leasehold or other real property rights (such as easements) for Project right-of- way or portions thereof acquired for a Facility as set forth in an approved Facility Implementation Plan or Facility Financial Plan. TxDOT shall have no obligation to acquire any Project right-of-way until such time as TxDOT agrees to acquire right-of- way as set forth in an approved Facility Implementation Plan. Project right-of-way shall be acquired in accordance with applicable Law.
