Toxic Substance Sample Clauses
The Toxic Substance clause defines the responsibilities and restrictions related to the use, handling, and disposal of hazardous or environmentally harmful materials within the scope of an agreement. It typically requires parties to comply with all applicable laws and regulations regarding toxic substances, and may obligate them to notify the other party of any such materials present or used on site. Toxic Substance. Deficiencies and breaches of rules regarding works with the risk of exposure to dust from asbestos or from materials containing asbestos. a. Chapter 442 of the FS states that manufacturers, importers or distributors of any toxic Substance shall prepare and provide each direct purchaser of such toxic substance with Material Safety Data Sheet (s), herein referred to as MSDS, which to the best of manufacturer’s, importer’s or distributor’s knowledge, is current, accurate and complete based on information then reasonably available to the manufacturer, importer or distributor. Upon notification of a new or revised MSDS the manufacturer, importer or distributor, on a timely basis not to exceed three (3) months after notification, shall provide the City with the revised information as it becomes available to the manufacturer, importer or distributor.
b. Failure to provide the MSDS, when applicable, shall be cause of rejection of proposal.
Toxic Substance. (a) Developing methods of assisting agencies in disseminating information with respect to toxic substances in accordance with current State regulations in order that employees are properly informed and trained;
(b) reviewing existing State procedures pertaining to work activities involving toxic substances and making appropriate recommendations for policy improvements;
(c) reviewing existing State procedures pertaining to work activities involving pesticides and making appropriate recommendations;
