TRACK a. Practices will be held as equitably as possible in Xxxxx-Xxxxxxx and Armour
TRACK. The Contractor shall be responsible for the proper upkeep and maintenance of track facilities in the areas over which it provides Service. Said upkeep and maintenance shall include but not be limited to:
a. Surface and alignment
b. Brush and vegetation control (all brush to be chipped)
c. Drainage and ditches
d. All operating signals to be kept in good operating condition
e. Crossing and switches to be kept in good operating condition. The Contractor shall provide a flagman during the passage of trains for the protection of any crossing protected by signals where the signal is not operating for any reason.
f. Snow removal and winter maintenance when needed for service.
3.2.2.1 The Contractor shall be responsible to perform all work and routine maintenance necessary to maintain the active service area from MP XX.XX in TOWN to MP XX.XX in TOWN at FRA Class (INSERT #) Track Safety Standards and all other remaining track from MP XX.XX in TOWN to MP XX.XX in TOWN shall be maintained at FRA Class (INSERT #) Track Safety Standards and in any event shall expend no less than twenty (20%) percent of Annual Gross Operating Revenue on actual track maintenance exclusive of inspections, and shall include a report of maintenance expenses on a form and according to a schedule to be specified by the State. (See EXHIBIT A). The Contractor’s performance shall satisfy all obligations required on the owner of a railroad, set forth in Part 213 of the FRA Track Safety Standards (49 CFR 213).
3.2.2.2 The Contractor shall obtain the State’s permission regarding any work performed on the Line(s) excluding the routine maintenance listed above. The State shall have no responsibility to pay for any maintenance work performed on the Line(s) by the Contractor that did not have the State’s authorization prior to the work being performed.
TRACK student attendance is monitored closely at regular intervals by staff, but is primarily the responsibility of students and their parents/carers.

TRACK. (i) GOSCNA and Holding Company each have separate rail spurs or track that enter their respective parcels from the main railroad line and each party will be solely responsible for maintaining and repairing its respective spurs.
(ii) Each party may from time to time desire to store rail cars on tracks located on the other party’s parcel. With respect to such rail car storage, GOSCNA and Holding Company agree to work together in the same good faith manner as the GOSCNA and Crop Nutrition business units used prior to the Effective Date and agree to the terms set forth on Exhibit C with respect to rail car storage.
(iii) Currently rail car switching services off the mainline for both parties are provided by the Port Terminal Rail Association (PTRA) and each party is billed separately for those services. Switching services will continue to be separately provided to both parties by the PTRA
TRACK. (i) The “Northyard Track” is the track that connects the mainline track (located outside Port Cargill) to Port Cargill at Xxxx Avenue (including several staging tracks) and services all Port Tenants that utilize rail transportation. The Northyard Track is owned by CAH, which currently leases that track to the Union Pacific Railroad (the “UP”). Currently the Northyard Track is maintained and repaired by the UP in accordance with its lease with CAH. In the event that the lease expires or is terminated, then the Port Tenants will reimburse CAH for any expenses to repair and maintain the Northyard Track based upon the respective Port Tenants’ use of the Northyard Track.
(ii) The section of track beginning at the point at which the track crosses Xxxx Avenue until the track enters the Holding Company Parcel (“Main Spur”) will be owned by Salt, but the maintenance and repair for the Main Spur will be shared equally between Holding Company and Salt, provided however that Holding Company will reimburse Salt for a portion of the expenses that Salt incurs to maintain, repair and replace the five (5) switches located along the Main Spur based upon its use of the Main Spur.
(iii) After the Main Spur enters the Holding Company Parcel, the portion of track located on the Holding Company Parcel (the “Mosaic Spur”) will be owned by Holding Company and will be maintained by Holding Company, provided that Salt will reimburse Holding Company for a portion of the maintenance based upon its use of the Mosaic Spur (which currently is rarely used by Salt).
TRACK. 1. When coaches at each site exist, practices will take place at the home site of the athlete. Team building practices for track will be scheduled through both Athletic Directors.
