Common use of Trade Names Clause in Contracts

Trade Names. No party shall use any other party's trade names, logos, trademarks or service marks, whether registered or unregistered, without the prior written consent of such other party, or after written consent therefor has been revoked. The Company shall not use in advertising, publicity or otherwise the name of the Trust, Distributor, or any of their affiliates nor any trade name, trademark, trade device, service ▇▇▇▇, symbol or any abbreviation, contraction or simulation thereof of the Trust, Distributor, or their affiliates without the prior written consent of the Trust or the Distributor in each instance. The Company acknowledges that the Distributor owns all right, title and interest in and to the ▇▇▇▇ and the registrations thereof. The Company shall use the ▇▇▇▇ intact and shall not modify or alter the ▇▇▇▇. Upon termination of this Agreement, the Company or its successor (to the extent and as soon as it lawfully can) will cease the use of the ▇▇▇▇.
