Common use of Train Operator Events of Default Clause in Contracts

Train Operator Events of Default. The following are Train Operator Events of Default: the Train Operator ceases to be authorised to be the operator of trains for the provision of the Services in accordance with Clause 3.2(a); an Insolvency Event occurs in relation to the Train Operator; any breach by the Train Operator of this contract, its Safety Obligations or any of the Collateral Agreements; or any event or circumstance which is reasonably likely to result in any such breach, which, by itself or taken together with any other such breach, event or circumstance, the CVL IM reasonably considers constitutes a threat to the safe operation of any part of the CVL; any Track Charges or other amount due by the Train Operator to the CVL IM under this contract remain unpaid for more than 7 days after their due date; any breach of this contract or any material breach of any of the Collateral Agreements by the Train Operator which, by itself or taken together with any other such breach, results, or is likely to result, in material financial loss to the CVL IM; and any breach of this contract or any material breach of any of the Collateral Agreements by the Train Operator which, by itself or taken together with any other such breach, results, or is likely to result, in material disruption to train operations of other train operators.
