In the event that a dispute exists between CONTRACTOR and the FDC relating to the non-routine transports and an agreement cannot be reached on a transport request, the Department shall make the final decision. 5.13.2. CONTRACTOR may request, in writing, that an inmate be transferred from the Facility. The Bureau, CONTRACTOR, and the FDC shall comply with the terms of the Transfer Agreement when transferring inmates between a correctional facility operated by the FDC and a privately operated facility. In the event that an agreement cannot be reached on a transfer request, the Bureau shall have the final decision on which inmates may be transferred from the Facility. Any decision by the Bureau Chief is final and not subject to appeal or challenge by CONTRACTOR in any civil or administrative forum, nor subject to any mediation or arbitration proceedings.
