Common use of Transfer of Rights of Recovery Against Others to Us Clause in Contracts

Transfer of Rights of Recovery Against Others to Us. If the insured has rights to recover all or part of any payment We have made under this policy, those rights are transferred to Us. The insured must do nothing after loss to impair them. At Our request, the insured will bring legal action or transfer those rights to Us and help Us enforce them. If We pay an innocent co-insured for loss arising out of an act of domestic violence by another insured, the rights of the innocent co-insured to recover damages from the abuser are transferred to Us to the extent of Our payment. Following the loss, the innocent co-insured may not waive such rights to recover against the abuser.
