Common use of Transmitting Electronic PHI Clause in Contracts

Transmitting Electronic PHI. Electronic PHI transmitted or otherwise transferred from between Covered Entity and Business Associate must be encrypted by a process that renders the Electronic PHI unusable, unreadable, or indecipherable to unauthorized individuals within the meaning of XXXXXX Xxx § 00000 and any implementing guidance including, but not limited to, 42 C.F.R. § 164.402.
