Transportation Services. Union shall, subject to the terms and conditions herein, transport Shipper’s gas on Union’s system (the “Transportation Services”). Shipper agrees to the following upon nomination to Union for the provision of the Transportation Services: (a) Contract Demand, Fuel Requirements, Term, Type of Transportation Service, Receipt Point and Delivery Point shall be as set out in Schedule 1. (b) Gas Transported by Union: (i) Union agrees, on any Day, and subject to Sections (b) ii) and (b) iii), to receive on Shipper's behalf at the Receipt Point, any quantity of gas which Shipper nominates and which Union has authorized for Transportation Service and to deliver that quantity of gas to Shipper at the Delivery Point as per Shipper’s nomination; (ii) Under no circumstances shall Union be required to transport a quantity of gas in excess of the Contract Demand; and, (iii) Union agrees that it shall, upon the request of Shipper, use reasonable efforts to transport gas in excess of the Contract Demand, as Authorized Overrun, on an interruptible basis, if applicable under Schedule 1 hereof; and (iv) Union agrees that it shall, upon request of Shipper, use reasonable efforts to accommodate changes to either the Receipt Point or Delivery Point, after the Timely Nomination Cycle, on an interruptible basis.
Transportation Services. These services may include, but not be limited to: provision of bus tickets; transportation to appointments deemed necessary for the Client care; or transportation for emergency psychiatric evaluation or treatment.

Except as provided below, CONTRACTOR shall compensate the transportation provider directly for such services, and shall charge the LEA for such services at the actual and reasonable rates billed by the transportation provider, plus a ten percent (.10) administrative fee, unless a “flat rate” is provided in the transportation contract. In the event that the transportation provider notifies the LEA or SELPA Director that CONTRACTOR is more than 90 days behind in payment for transportation services, LEA shall have the right, in its sole and exclusive discretion, but not the obligation, to make payment for such services directly to the transportation provider, and to deduct such payments from any sums owed to CONTRACTOR pursuant to this Master Contract and any Individual Services Agreement between the parties. In the event that the LEA makes direct payment of the transportation provider’s charges, it shall be entitled to withhold both the transportation charges themselves and such additional amount as shall be reasonably necessary to compensate the LEA for the staff and other costs incurred in making direct payment of those charges. The remedies provided to the LEA pursuant to this Paragraph shall not be exclusive. CONTRACTOR shall not include transportation through the use of services or equipment owned, leased or contracted through the LEA unless expressly provided in the Individual Services Agreement for the pupil transported. When CONTRACTOR is a nonpublic agency, CONTRACTOR shall not provide transportation nor subcontract for transportation services for LEA pupil unless the LEA and the CONTRACTOR agree otherwise in writing.
Transportation Services. Enbridge shall, subject to the terms and conditions herein, transport Shipper’s gas on Enbridge’s system (the “Transportation Services”). Shipper agrees to the following upon nomination to Enbridge for the provision of the Transportation Services: (a) Type of Transportation Service, Contract Demand, Receipt Points, Delivery Points and Transportation Service Paths, and Fuel Requirements shall be as set out in Schedule 1.

COUNTY shall only pay for medical ambulance or medical van transportation to and 36 from designated residential substance use disorder treatment programs or health facilities through the 37 COUNTY’s Medical Transportation Agreement under the following conditions: 1 1) Ambulance transportation shall be used for services requiring immediate attention 2 for a Client due to any sudden or serious illness or injury requiring immediate medical attention, where 3 delay in providing such services may aggravate the medical condition or cause the loss of life. 4 2) When any Client needs non-emergency transportation as identified in 5 Subparagraph 22.b below, and CONTRACTOR cannot transport Client due to unforeseen circumstances 6 including, but not limited to, staffing constraints, CONTRACTOR vehicle access within a timely 7 manner or Client’s physical condition and/or limitations. 8 3) CONTRACTOR shall utilize the COUNTY’s Ambulance Monthly Rotation Call 9 Log to request transportation services from Ambulance Providers designated for transportation within 10 the city of the CONTRACTOR’s facility for each said month as identified on the log. 11 4) CONTRACTOR shall use its best efforts to contact Ambulance Providers 12 identified on the Monthly Rotation Call Log as those providers who offer van transportation services if 13 and when an ambulance is not required. 14 5) CONTRACTOR shall be held liable and may be billed by the Ambulance Provider 15 for services requested by CONTRACTOR that are deemed inappropriate for use and not a covered 16 service under this section by the COUNTY. 17 b. Non-Emergency Transportation – CONTRACTOR shall transport Client to locations 18 that are considered necessary and/or important to the Client's recovery plan including, but not limited to, 19 Social Security Administration offices for Supplemental Security Income benefits and for non- 20 emergency medical or mental health services not identified in Subparagraph 22.a. above, that require 21 treatment at a physician office, urgent care, or emergency room when an ambulance provider is not 22 necessary or required for transportation based on the level of severity and/or services required by the 23 Client.

Transportation Services i) The School may contract with Sponsor to provide transportation for students to and from school. The Sponsor shall retain the state and local district allocated funds for transportation for the above transported students. The School will also pay the additional annual per student transportation cost that the Sponsor incurs. ii) Notwithstanding the provisions of the preceding paragraph, the Sponsor may allow the School to lease one (1) or more buses for a monthly fee and mileage rate at the Sponsor’s cost and as mutually agreed between the parties. The School shall retain applicable state and local transportation funds for students transported by the School pursuant to such lease.
