Common use of Treatment as Sale Clause in Contracts

Treatment as Sale. It is the express and specific intent of the parties ----------------- that the transfer of the Contracts and the other Transferred Assets relating thereto from the Seller to Company, as provided in this Section 2 (each, a --------- "Purchase"), is and shall be construed for all purposes as a true, complete and absolute sale of such Contracts and Transferred Assets.
