Common use of Treatment by Major Suppliers Clause in Contracts

Treatment by Major Suppliers. Each Party shall ensure that a major supplier in its Area accords to suppliers of public telecommunications transport networks and services of the other Party treatment no less favorable than that such major supplier accords in like circumstances to itself, its subsidiaries and affiliates, or any non-affiliated service suppliers regarding: (a) the availability, provisioning, rates or quality of like telecommunications services; and (b) the availability of technical interfaces necessary for interconnection. Note: For Japan, this Article shall be applied only to a major supplier which has control over essential facilities.
