Common use of Treatment of Holders of Warrant Certificates Clause in Contracts

Treatment of Holders of Warrant Certificates. At all such times as any Warrant is held pursuant to the Unit Agreement, the Company, the Warrant Agent and all other Persons may treat the Holder of the related Unit as the Holder of the Warrant Certificate evidencing such Warrant for any purpose and as the Person entitled to exercise the rights relating to such Warrant and Warrant Certificate, any notice to the contrary notwithstanding. After the date that a Warrant is no longer held pursuant to the Unit Agreement and prior to due presentment of the related Warrant Certificate for registration of transfer, the Company and the Warrant Agent may treat the registered Holder of such Warrant Certificate as the absolute Holder thereof for any purpose and as the Person entitled to exercise the rights relating to such Warrant and Warrant Certificate, any notice to the contrary notwithstanding.
