Common use of Treatment of Holders Clause in Contracts

Treatment of Holders. (a) The Corporation, the Warrant Agent and any agent of the Corporation or the Warrant Agent may deem and treat the Person in whose name each Global Warrant Certificate shall be registered in the records of the Warrant Agent as the absolute Holder of all right, title and interest in such Global Warrant Certificate (notwithstanding any notation of ownership or other writing thereon) for all purposes hereunder and as the Person entitled to exercise the rights represented by the Warrants evidenced thereby, whether or not such Warrants shall be exercised or deemed to be exercised, and neither the Corporation nor the Warrant Agent, nor any agent of the Corporation or the Warrant Agent shall be affected by any notice to the contrary, except that the Warrant Agent and the Corporation shall be entitled to rely on and act pursuant to instructions of Depository Participants as contemplated by Article II of this Agreement.
