Common use of Trust Monies Not Subordinated Clause in Contracts

Trust Monies Not Subordinated. Notwithstanding anything contained herein to the contrary, payments from money, U.S. Government Obligations and/or Foreign Government Obligations held in trust under Article 4 or Article 13 by the Trustee for the payment of the principal of, premium, if any, and interest on the Securities shall not be subordinated to the prior payment in full of any Senior Debt of the Company or subject to the restrictions set forth in this Article 15, and none of the Holders shall be obligated to pay over any such amount to the Company or any holder of Senior Debt of the Company or any other creditor of the Company.

Notwithstanding anything contained herein to the contrary, payments from money, money or the proceeds of U.S. Government Obligations and/or Foreign Government Obligations held in trust under Article 4 or Article 13 XI by the Trustee for the payment of the principal of, and premium, if any, and interest on on, the Debt Securities shall not be subordinated to the prior payment in full of any Senior Debt of the Company Indebtedness or subject to the restrictions set forth in this Article 15XIV, and none of the Holders thereof shall be obligated to pay over any such amount to the Company or any holder of Senior Debt Indebtedness of the Company or any other creditor of the Company.
