Common use of Trustee as Holder of Senior Indebtedness Clause in Contracts

Trustee as Holder of Senior Indebtedness. The Trustee shall be entitled to all rights set forth in this Article with respect to any Senior Indebtedness at any time held by it, to the same extent as any other holder of Senior Indebtedness. Nothing in this Article shall deprive the Trustee of any of its rights as such holder. Nothing in this Article Fifteen shall apply to the claims of, or payments to, the Trustee under and pursuant to Section 907.

The Trustee in its individual capacity shall be entitled to all the rights set forth in this Article with Eighteen in respect to of any Senior Indebtedness at any time held by it, it to the same extent as any other holder of Senior Indebtedness. Nothing Indebtedness and nothing in this Article Indenture shall be construed to deprive the Trustee of any of its rights as such holder. Nothing in this Article Fifteen shall apply to the claims claims, of, or payments to, the Trustee under and or pursuant to Section 9076.07.
