Common use of Trustee May Perform Clause in Contracts

Trustee May Perform. Without limiting the authority granted under Section 1(g) and except with respect to the failure of the Company to deliver investment instructions, which shall be governed by Section 2(c) hereof, if the Company fails to perform any agreement contained herein, the Trustee may, but shall not be obligated to, itself perform, or cause performance of, such agreement, and the expenses of the Trustee incurred in connection therewith shall be payable by the Company. In the event that the Trustee performs pursuant to this Section 1(h), the Company shall indemnify the Trustee in the manner provided in Section 607 of the Indenture.

In the event that the Trustee performs pursuant to this Section 1(h), the Company shall indemnify the Trustee in the manner provided in Section 607 7.07 of the Indenture.

In the event that the Trustee performs pursuant to this Section 1(h), the Company and shall indemnify the Trustee in the manner provided in Section 607 of the Indenturebe deemed Secured Obligations hereunder.
