Trustee or Receiver Clause Samples

The 'Trustee or Receiver' clause defines the rights and procedures that apply if a party to the agreement becomes subject to insolvency proceedings, such as the appointment of a trustee or receiver. Typically, this clause outlines what happens to the contractual obligations and rights if one party is declared bankrupt or is placed under the control of a court-appointed official. For example, it may specify whether the contract can be terminated or if certain actions must be taken to protect the interests of the non-insolvent party. The core function of this clause is to provide clarity and protection for parties in the event of insolvency, ensuring that the agreement addresses the risks associated with financial distress.
