Common use of Trustee's Liens Clause in Contracts

Trustee's Liens. The Trustee in its individual capacity agrees that it will at its own cost and expense promptly take any action as may be necessary to duly discharge and satisfy in full any mortgage, pledge, lien, charge, encumbrance, security interest or claim ("Trustee's Liens") on or with respect to the Trust Property which is attributable to the Trustee either (i) in its individual capacity and which is unrelated to the transactions contemplated by this Agreement, the Intercreditor Agreement, the Note Purchase Agreement or the Financing Documents, or (ii) as Trustee hereunder or in its individual capacity and which arises out of acts or omissions on the part of the Trustee which are not contemplated by this Agreement.

Trustee's Liens. The Trustee in its individual capacity agrees that it will will, in respect of each Trust created by this Agreement, at its own cost and expense promptly take any action as may be necessary to duly discharge and satisfy in full any mortgage, pledge, lien, charge, encumbrance, security interest or claim ("“Trustee's ’s Liens"”) on or with respect to the Trust Property of such Trust which is attributable to the Trustee either (i) in its individual capacity and which is unrelated to the transactions contemplated by this Agreement, the Intercreditor Agreement, the Note Purchase Agreement or the Financing Documents, related Note Documents or (ii) as Trustee hereunder or in its individual capacity and which arises out of acts or omissions on the part of the Trustee which are not contemplated by this Agreement.

Trustee's Liens. The Trustee Trustee, in its individual capacity capacity, agrees that it will at its own cost and expense promptly take any action as may be necessary to duly discharge and satisfy in full any mortgage, pledge, lien, charge, encumbrance, security interest or claim ("Trustee's Liens") on or with respect to the Trust Property which is either (i) attributable to the Trustee either (i) in its individual capacity and which is unrelated to the transactions contemplated by this Agreement, the Intercreditor Agreement, the Note Purchase Trust Agreement or the Financing other Transaction Documents, or (ii) which is attributable to the Trustee as Trustee trustee hereunder or in its individual capacity and which arises arise out of acts or omissions on the part of the Trustee which are not contemplated prohibited by this Trust Agreement.

The Trustee in its individual capacity agrees that it will at its own cost and expense promptly take any action as may be necessary to duly discharge and satisfy in full any mortgage, pledge, lien, charge, encumbrance, security interest or claim ("Trustee's Liens") on or with respect to the Trust Property which is attributable to the Trustee either (i) in its individual capacity and which is unrelated to the transactions contemplated by this Agreement, the Intercreditor Agreement, the Note Purchase Agreement or the Financing Documents, or (ii) as Trustee hereunder or in its individual capacity and which arises out of acts or omissions on the part of the Trustee which are not contemplated by this Agreement.

Trustee's Liens. The Trustee Trustee, in its individual capacity capacity, --------------- agrees that it will at its own cost and expense promptly take any action as may be necessary to duly discharge and satisfy in full any mortgage, pledge, lien, charge, encumbrance, security interest or claim ("Trustee's Liens") on or with respect to the Trust Property of any Trust which is either (i) attributable to the Trustee either (i) in its individual capacity and which is unrelated to the transactions contemplated by this Basic Agreement, the Intercreditor Agreementany Trust Supplement, the Note Purchase related Participation Agreement or the Financing related Note Documents, or (ii) attributable to the Trustee as Trustee trustee hereunder or in its individual capacity and which arises arise out of acts or omissions on the part of the Trustee which are not contemplated prohibited by this AgreementBasic Agreement or any Trust Supplement.

Trustee's Liens. The Indenture Trustee in its individual capacity agrees that it will at its own cost and expense promptly take any such action as may be necessary to duly discharge and satisfy in full any mortgage, pledge, lien, charge, encumbrance, security interest or claim all Liens ("Trustee's Liens") on or with respect to the Trust Property Indenture Estate which is attributable to the Trustee are either (i) attributable to the Indenture Trustee in its individual capacity and which is are TRUST INDENTURE AND SECURITY AGREEMENT [N396SW] -48- 55 unrelated to the transactions contemplated by this Agreement, the Intercreditor Agreement, the Note Purchase Agreement or the Financing DocumentsOperative Agreements, or (ii) which are attributable to the Indenture Trustee as Trustee trustee hereunder or in its individual capacity and which arises arise out of acts or omissions on the part of the Trustee which are not expressly contemplated by this Agreement.

Trustee's Liens. The Indenture Trustee in its individual capacity agrees that it will at its own cost and expense promptly take any such action as may be necessary to duly discharge and satisfy in full any mortgage, pledge, lien, charge, encumbrance, security interest or claim all Liens ("Trustee's Liens") on or with respect to the Trust Property Indenture Estate which is attributable to the Trustee are either (i) attributable to the Indenture Trustee in its individual capacity and which is are TRUST INDENTURE AND SECURITY AGREEMENT [N397SW] -48- 55 unrelated to the transactions contemplated by this Agreement, the Intercreditor Agreement, the Note Purchase Agreement or the Financing DocumentsOperative Agreements, or (ii) which are attributable to the Indenture Trustee as Trustee trustee hereunder or in its individual capacity and which arises arise out of acts or omissions on the part of the Trustee which are not expressly contemplated by this Agreement.
